Are Legal Prepaid Services a Good Idea?
Legal Prepaid Services are a growing field of legal practice which is often controversial. The reason for this is that it works very well for some individuals and businesses, but is often not appropriate for others.
If the services covered are ones that you are likely to use, and the providers (attorneys and assistants) are highly qualified in your areas of need, then you can save money by participating.
In some cases, an employer or association you belong to may make such plans available to employees and/or members and be able to negotiate competitive rates on your behalf. However, simply having a plan in place is no guarantee that the services covered by the plan will best meet your needs.
This is because plans are often tailored to the “typical client” and you may not be a typical client for that particular legal firm or group of attorneys. One good question to ask before choosing a prepaid legal service is this one, “Who are those attorneys representing when they are not representing me?”
If they are representing employees elsewhere, or union members, and you are an employee or union member, it may be a perfect fit. Likewise, if you are a business owner or manager, you will want attorneys who typically serve that segment of the labor market.
Many times prepaid legal services include protection or insurance of some sort, along with the necessary legal assistance should your “protective shield” be penetrated. For example, ideally identity theft protection makes it more difficult for someone to steal your identity, but it can still happen.
In such a case, it often takes a strong advocate to get through the legal maze of damages to one’s credit, ability to conduct bank transactions or get loans, obtain a job, get educational grants, discharge debts created fraudulently, obtain a passport, travel or simply avoid being arrested for a crime committed by an impersonator.
Some prepaid legal services are designed for specific small businesses, such as landlords, who need to make certain that lease or rental agreements are legal and binding, make sure liability coverage will include issues with tenants, visitors or employees and be certain that they are in compliance with a number of laws governing the landlord/tenant relationship.
It may be wise to examine the plans offered like a menu. Some services may come with the entrée, while others will be billed ala carte. Are these charges promised to be somewhat reduced as compared with obtaining such services on your own? Are all the services you are most likely to use completely covered by the plan?
Often these services cover basics like reviewing insurance policies or contracts, assisting with wills and trusts, incorporating a business and other expected legal needs. However, you cannot assume that any and all legal issues you might encounter can be handled correctly without paying additional charges or using an attorney not available on your plan. Many plans cover bare bones only and charge fees beyond those basic services.
The most important thing is that you have a clear understanding of what you are paying for up front, an honest assessment of which services you really need and some assurance that the individual or firm you are dealing with has a reputation for fair and reliable treatment of clients in time of need.
